General Terms and Conditions

 

Article 1. General 

1.1 The general terms and conditions of delivery apply to all agreements with the Equine Gait Analysis Society (EGAS) concerning participation in or orders for symposia, congress days, courses, refresher courses, training sessions and other forms of education, or consultancy in the broadest sense of the word, hereinafter referred to as ‘courses’ or ‘course’.

1.2 Deviations from these conditions are only binding if and insofar as they have been confirmed in writing by the Equine Gait Analysis Society (EGAS).

1.3 In these conditions, the following definitions apply:

- Equine Gait Analysis Society (EGAS), Ypeloschoolweg 21, 7642 ND Wierden, The Netherlands, CoC no. 92691110

- Client: a person, who applies for participation in a course; a company, who applies for participation in a course.

- Participant: a person who participates in a course.

 

Article 2. Formation of the agreement 

2.1 The agreement between Equine Gait Analysis Society (EGAS) and the client for participation in a course is established by sending the appropriate registration or application form by the client and/or by written confirmation from Equine Gait Analysis Society (EGAS) to the client by email or registration received via the Internet. 

 

Article 3. Terms of payment for courses 

3.1 The invoice of the participation fee due will be sent by e-mail to the e-mail address provided by the client, which includes the invoice address, which otherwise does not affect the participant's own payment obligation towards the Equine Gait Analysis Society (EGAS). The invoice must be paid within 14 days of the invoice date, but if the course falls within this period then the invoice must be paid immediately and at the latest before the start of the course. 

3.2 If the client remains in default of payment of the participation fee due, the Equine Gait Analysis Society (EGAS) shall be at liberty to outsource the claim for collection. In that case, both the judicial and extrajudicial collection costs will be borne by the client. These will always include the costs of collection agencies, as well as the actual costs incurred and the wages of bailiffs and lawyers, even if these exceed the legally awarded legal costs. 

3.3 Equine Gait Analysis Society (EGAS) is entitled to refuse the participation of the client or of the participant designated by the client, if the payment obligation has not been fulfilled in time. 

3.4 If payment is not made within 14 days, a first reminder with an urgent request to proceed with payment will be sent by email. If no payment has been made after the first reminder, a second reminder will follow. In the event of a third reminder, the client is reminded that if payment is not made within 10 days, the payment will be handed over to a collection agency. 

 

Article 4. Cancellation and substitution by the participant/client 

4.1 The participant/client is entitled to cancel participation in a course or the assignment of a course without giving reasons. This must always be done in writing. 

4.2 In case of cancellation within 30 days before the start of the course, or in case of no-show at the course without early cancellation, 100% of the participation fee is due. 

4.3 If a participant in a course has had to miss a significant part of the course due to force majeure (such at the discretion of Equine Gait Analysis Society (EGAS)), he will be given the opportunity to catch up the missed part at the next repetition, a so-called catch-up moment, of the course. Any costs of course materials, speakers and catering facilities, as well as any price increase of the participation fee, will be charged at that time. However, Equine Gait Analysis Society (EGAS) is never obliged to refund the participation fee, even if the repeat is no longer organised. 

4.4 In the event of sudden impediment, a participant in a course may be replaced by a colleague before the start of the course, without charge. 

 

Article 5. Cancellation by Equine Gait Analysis Society (EGAS)

5.1 Equine Gait Analysis Society (EGAS) reserves the right to cancel a course in case of insufficient enrolments or due to unforeseen circumstances regarding the execution of the course. 

5.2 In case of unforeseen circumstances, Equine Gait Analysis Society (EGAS) reserves the right to move the course to another location or reschedule to a date to be determined. 

5.3 In case of full cancellation by Equine Gait Analysis Society (EGAS) and if the participation fee has already been paid, Equine Gait Analysis Society (EGAS) will refund the full amount paid by return of post. The participant has no claim to compensation whatsoever. 

 

Article 6. Written material and oral instruction 

6.1 All material provided by Equine Gait Analysis Society (EGAS) in the context of a course is subject to copyright. This includes all texts, videos, images, audio and video recordings. It is not permitted to reproduce, store, transmit or redistribute any of these materials without the prior written consent of the Equine Gait Analysis Society (EGAS) . 

6.2 Equine Gait Analysis Society (EGAS) accepts no liability for participants' compliance with and/or interpretation of the recommendations laid down in the written material and/or of verbal instructions given during the performance of the activity. 

 

Article 7. Force majeure and liability 

7.1 Equine Gait Analysis Society (EGAS) makes every effort to carry out the assignments given to the best of its knowledge and ability. 

7.2 Equine Gait Analysis Society (EGAS) cannot be held responsible for administrative errors made by a participant/client when registering for a course. Any additional costs will be charged by Equine Gait Analysis Society (EGAS). 

7.3 If it is impossible for a speaker or instructor to deliver a course due to unforeseen circumstances, Equine Gait Analysis Society (EGAS) will attempt to deploy a substitute instructor. If this proves impossible, Equine Gait Analysis Society (EGAS) reserves the right to reschedule the course to a date to be determined. 

7.4 Equine Gait Analysis Society (EGAS) is not liable for any damage a participant/client may suffer as a result of a course not going ahead. 

7.5 Equine Gait Analysis Society (EGAS) is not liable for any damage, which the participant/client may suffer as a result of or during a course. 

7.6 Equine Gait Analysis Society (EGAS) reserves the right to replace the course leaders and teachers mentioned in the course information, without giving the participant/client the right to cancel his/her registration for a course other than as provided for in article 5 of these general terms and conditions. 

 

Article 8. Protection of Personal Data 

8.1 Equine Gait Analysis Society (EGAS) makes every effort to protect the privacy of the participant/client. Personal data are processed and used in accordance with the General Data Protection Regulation (AVG). All information regarding the protection of personal data can be found in the privacy policy on the website of the Equine Gait Analysis Society (EGAS).

 

Article 9. Disputes 

9.1 Dutch law applies to any agreement between the Equine Gait Analysis Society (EGAS) and a participant/client. 

9.2 Disputes arising from agreements to which these conditions apply will be submitted to the competent court in the place of establishment of Equine Gait Analysis Society (EGAS), barring appeal.
